Horse & Foal Purchase Agreement

 This agreement is made between ____________________________________(buyer) residing at _________________________________(buyer) and John and Becky Edison residing at Cordell, Oklahoma(seller) for the purchase described below. Name of Horse/Foal:________________________________ Color:_______________ 

Breed:_________________ Sex:______ Registration:_______________

 Purchase Price: For the total sum of $_________, Seller agrees to sell and Buyer agrees to buy said horse(s) based on the terms to follow. 

Payment Terms: The buyer agrees to pay $_________ as a deposit on __________(m/d/y) and the remaining balance in full on or before _______________(m/d/y). 

Warranties:(a)   Seller covenants that he/she is the lawful owner of said horse. That he/she has the right to sell the horse and that he/she will warrant and defend the horse(s) against lawful claims and demands of all persons.(b)  Seller makes no other promises, express or implied, including warranties of fitness and health, nor fitness and health for a particular purpose unless further provided in section “Special Provisions and/or Contingencies of this Sale”. Buyer has the option of having a veterinarian’s examination done at buyers expense. This examination must be performed before the signing of this agreement.(c)    Buyer is responsible for all veterinary, testing and transportation, planning and expenses including coggins and health certificate.(d)   Transfer of ownership: Once seller has received payment in full, seller shall transfer ownership and signed registration papers or registration application for transfer of said horse to the buyer. Any and all transfer and registration fees shall be the obligation of the buyer. Horse must be paid in full and all other charges must be paid in full before horse(s) is to leave the seller.

Risk Of Loss: Should buyer not to pay the horse in full, including all boarding fees by ________Seller will have the right to resell the horse(s) and buyer will lose the down payment made and all payments paid to seller. 

Governing Laws:The terms of this agreement shall be governed by the laws of the State of Oklahoma.  

Death of Said Horse: Should death occur to described horse before it has been paid for in full, A FULL REFUND of the payments or deposit shall be made. No refund will be made after the horse is paid in full or after the horse(s) leaves the seller. 

Special Provisions and/or Contingencies of this Sale: Horse(s) can stay with the seller for no charge till ___________, boarding fee will be $5.00 per day there after. All boarding fees must be paid in full before horse(s) is to leave the seller. 

Entire Agreement: This constitutes the entire agreement between the parties. Any modifications or additions MUST be in writing and signed by both parties to the Agreement. No Oral modifications or additions will be considered to be a part of this agreement unless reduced to writing and signed by both parties. Executed on this __________(day) of _______________(month),____________(year)
